The Nest Counseling Collective (“we,” “our,” or “us”) is committed to protecting your Protected Health Information (PHI) in compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA). This notice explains how we collect, use, and protect your health information and your rights regarding that information.
1. What is PHI?
Protected Health Information (PHI) includes any individually identifiable health information you provide to us, whether in writing, electronically, or verbally. Examples include:
- Name, address, date of birth
- Medical history and mental health records
- Treatment plans and session notes
- Billing and payment information
We create a record of the care and services you receive from us to provide quality care and comply with legal requirements. This notice applies to all records of your care generated by our practice.
2. How We Use Your PHI
We may use or disclose PHI for the following purposes:
- Treatment – Sharing information with therapists or other healthcare providers involved in your care to ensure proper treatment.
- Payment – Using PHI to process billing, insurance claims, or payment for services.
- Healthcare Operations – Administrative activities such as quality assurance, staff training, supervision, and compliance audits.
3. Disclosure of PHI
We do not sell or use your PHI for marketing purposes. PHI may only be disclosed without your written authorization in limited situations required by law, including:
- Risk of harm to yourself or others
- Suspected abuse, neglect, or domestic violence
- Court orders, subpoenas, or other legal requirements
- Public health activities, including reporting of certain communicable diseases

We implement administrative, technical, and physical safeguards to protect your PHI from unauthorized access, disclosure, or misuse, including:

- Password-protected devices
- Locked storage for physical documents
- Staff training on privacy practices
5. Your HIPAA Rights
Under HIPAA, you have the following rights regarding your PHI:
- Right to Access – Request copies of your records (except psychotherapy notes).
- Right to Amend – Request corrections to your records.
- Right to Request Restrictions – Ask us to limit uses or disclosures of PHI.
- Right to Confidential Communications – Request alternate methods of communication (e.g., mail to a different address).
- Right to Accounting of Disclosures – See a list of disclosures made without your consent.
- Right to File a Complaint – If you believe your privacy rights were violated, you may file a complaint with us or the U.S. Department of Health and Human Services (HHS).
