The Nest Counseling Collective (“Company,” “we,” “our,” or “us”) provides therapy and counseling services to clients (“you,” “your,” or “Client”). By accessing our website or engaging in services, you agree to these Terms of Service (“Terms”). Please read them carefully.
1. Acceptance of Terms
By using our website or engaging in services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
2. Services
We provide professional therapy and counseling services, including private consultations, either in-person or online. Services are provided based on your individual needs and the professional judgment of our licensed therapists.
While we strive to provide high-quality care, we cannot guarantee specific outcomes, results, or improvements. Therapy is a personal process, and results vary from person to person.
3. Appointments and Cancellations
Please remember to cancel or reschedule at least 24 hours in advance. You will be responsible for the full session fee if cancellation occurs with less than 24 hours’ notice.
The standard meeting time for psychotherapy is 50 minutes. Any request to modify session length must be discussed and approved in advance to ensure proper scheduling.
If you are late for a session, your appointment will still end at the scheduled time, and you will be charged for the full session.
A $10.00 service charge will apply for any returned checks.
Cancellations or rescheduled sessions not received at least 24 hours in advance are subject to full charge. This policy is necessary because each appointment time is reserved exclusively for you.
4. Payments and Fees
Session fees will be communicated before scheduling and may vary based on session type or therapist.
Payment is due at the time of service unless otherwise agreed upon in writing.
Accepted payment methods include credit card, debit card, Zelle, Venmo, check, and FSA/HSA.
Failure to pay fees as agreed may result in suspension or termination of services.
5. Telephone and Electronic Accessibility
If you need to contact your therapist between sessions, please leave a message. Calls are generally returned within 24 hours (excluding weekends and holidays). Face-to-face sessions are preferred, but phone or telehealth sessions may be offered when appropriate.
In the event of an emergency, call 911 or go to the nearest emergency room.
Our therapists cannot provide 24-hour crisis services.
6. Electronic Communication and Telehealth
Communication via electronic means (including text, email, and video conferencing) carries some risk to confidentiality.
If you choose to communicate electronically for scheduling or administrative matters, you consent to the associated risks. Therapeutic content should not be shared by text or email.
Telehealth sessions are governed by applicable laws and professional standards. By engaging in telehealth, you acknowledge:
- You may withdraw consent at any time without affecting future care.
- All confidentiality protections apply equally to telehealth.
- You have the right to access any records generated during telehealth services.
- No identifiable images or recordings will be shared without your written consent.
- Telehealth has benefits (e.g., convenience, access to care) and limitations (e.g., reduced ability for your therapist to observe nonverbal cues).
7. Social Media and Professional Boundaries
To protect your privacy and maintain professional boundaries, our therapists do not accept friend or connection requests from current or former clients on social media (e.g., Facebook, LinkedIn, Instagram). This helps preserve confidentiality and uphold ethical standards.
8. Confidentiality
All sessions are confidential and protected by state and federal laws as well as professional ethics.
Exceptions to confidentiality include:
- Threat of harm to self or others
- Suspected abuse or neglect of a child, elder, or dependent adult
- Court orders or other legal mandates

9. Minors
If you are under 18, your parent or guardian may have legal rights to certain information about your therapy. Your therapist will discuss with you and your parent(s) what information will be shared and what remains confidential to protect the therapeutic process.
10. Termination of Services
Therapy may conclude by mutual agreement when treatment goals are met, or at your request at any time.
Your therapist may also initiate termination after appropriate discussion if:
- Therapy is not being effectively used
- You have defaulted on payments
- You have not scheduled sessions for three consecutive weeks without prior arrangement
In such cases, referrals to other qualified providers will be offered.
11. Use of Website
You agree to use our website for lawful purposes only.
You may not copy, reproduce, or distribute any website content without prior written permission.
We are not responsible for third-party websites linked from our site.
12. Intellectual Property
All website content, including text, graphics, images, and logos, is the property of The Nest Counseling Collective or its licensors and is protected by copyright and other intellectual property laws.
13. Limitation of Liability
To the maximum extent permitted by law, The Nest Counseling Collective and its affiliates are not liable for any indirect, incidental, or consequential damages resulting from your use of our website or services. Participation in therapy is at your own discretion and risk.
14. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes will be resolved under applicable state and federal law.
15. Changes to These Terms
We may update these Terms periodically. The “Effective Date” above reflects the most recent version. Continued use of our website or services indicates acceptance of any updated Terms.
